J M HURST PLUMBING AND HEATING LTD: TERMS AND CONDITIONS
1. INTERPRETATION
“The Company” means J M HURST PLUMBING AND HEATING LTD.
“The Customer” means the person or organization engaging the Company for services.
“The Contract” means the agreement formed by the Customer’s acceptance of a Quote or Estimate.
2. QUOTATIONS AND ESTIMATES
2.1 Estimates: Provided as a guide only. Final charges will be based on actual time spent and materials used.
2.2 Quotes: A fixed price for the specific scope of work described. Any additional work requested will be treated as an "extra" and charged accordingly.
2.3 Validity: All quotes are valid for 30 days. The Company reserves the right to adjust pricing after this period due to material cost fluctuations.
3. RIGHT TO CANCEL (COOLING-OFF PERIOD)
3.1 Statutory Right: Under the Consumer Contracts Regulations 2013, domestic customers have a 14-day right to cancel this contract without penalty, starting from the date of acceptance.
3.2 Urgent Works: If you request the Company to commence work immediately (e.g., emergency repairs), you acknowledge that your right to cancel is waived once the service is fully performed. If you cancel after work has started but before it is finished, you will be liable for the cost of labor and materials supplied up to the point of cancellation.
3.3 How to Cancel: You must notify the Company in writing via email to : contact@jhurstplumbing.co.uk.
4. PAYMENT TERMS
4.1 Timing: Payment is due immediately upon completion of the works and presentation of an invoice, unless otherwise stated in the Quote.
4.2 Deposits: A deposit of 50% is required for all boiler installations and works exceeding £1,000 to secure materials.
4.3 Late Payment: Interest may be charged at 4% above the Bank of England base rate on all overdue balances.
5. CUSTOMER OBLIGATIONS
5.1 Access: The Customer shall ensure clear and safe access to the property, gas meter, and water supplies at the agreed time.
5.2 Existing Systems: The Company accepts no liability for the failure of pre-existing components (e.g., aged radiators, valves, or pipework) that may fail during or after works such as system power flushing or pressurized testing, unless caused by the Company's negligence.
6. WORKMANSHIP AND MATERIALS
6.1 Guarantee: Workmanship is guaranteed for 12 months. This does not cover faults caused by misuse, external interference, or lack of maintenance.
6.2 Title to Goods: All materials remain the property of J M HURST PLUMBING AND HEATING LTD until the invoice is paid in full. This excludes any materials purchased by The Customer prior to any works taking place.
6.3 Manufacturing Warranties: Boilers and appliances are subject to the manufacturer’s warranty. It is the Customer's responsibility to register the warranty and ensure annual servicing is carried out by a Gas Safe registered engineer to maintain coverage.
7. LIMITATION OF LIABILITY
7.1 The Company is not liable for structural defects or pre-existing plumbing/heating issues not disclosed by the Customer.
7.2 The Company will take all reasonable care but is not responsible for the cost of "making good" (re-decorating, tiling, or flooring) necessitated by gaining access to pipework, unless specifically included in the Quote.
